IYILO Terms & Conditions of Sale and Use
These Terms & Conditions of Sale and Use (“Terms”) govern your access to and use of the IYILO website, IYILO mobile application, IYILO EV charging products, accessories, software, and related services.
IYILO is a brand owned and operated by EVRA ENERGY LLC (“EVRA,” “IYILO,” “we,” “us,” or “our”).
By accessing the IYILO website, creating an account, downloading or using the IYILO App, purchasing an IYILO product, or installing or using an IYILO charger, you agree to be bound by these Terms and the policies referenced herein.
If you do not agree to these Terms, you should not purchase, install, access, or use IYILO products or services.
1. Scope of Products and Services
These Terms apply to:
• The IYILO website and online store;
• IYILO EV chargers and accessories;
• The IYILO mobile application;
• Embedded charger software and firmware;
• Warranty and technical support services; and
• Other related IYILO services.
Additional policies, including our Privacy Policy, Shipping Policy, Return & Refund Policy, Payment Policy, and Limited Warranty, form part of these Terms where applicable.
2. User Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase IYILO products or create an IYILO account.
By using our products or services, you represent that you are legally capable of entering into a binding agreement.
3. Accounts and Access
Certain IYILO App and service features may require account registration.
You are responsible for:
• Providing accurate and current account information;
• Maintaining the confidentiality of your login credentials;
• All activity occurring through your account; and
• Promptly notifying IYILO of suspected unauthorized access.
IYILO may suspend or restrict access where we reasonably believe there is fraud, misuse, a security risk, or a violation of these Terms.
4. Orders, Pricing and Payment
All orders are subject to availability and acceptance by IYILO.
Prices are displayed in the applicable currency shown on the Website and may change without prior notice before an order is placed.
Payment may be processed through third-party payment providers, including Shopify Payments, PayPal, and other authorized payment services.
IYILO does not directly store complete payment-card information.
We may cancel or hold an order where additional verification is reasonably required to prevent fraud or unauthorized transactions.
5. Taxes, Duties and International Orders
Applicable sales taxes will be calculated where required by law.
For orders shipped within the United States, applicable state and local sales taxes may be collected at checkout.
For Canadian orders, shipping, duties, taxes, and customs charges will be handled in accordance with the current IYILO Shipping Policy, including any Delivered Duty Paid (“DDP”) terms offered at the time of purchase.
Customers in other countries may be responsible for VAT, GST, import duties, customs fees, brokerage charges, or other applicable taxes unless otherwise stated at checkout.
6. Shipping and Delivery
Order processing times, shipping methods, delivery estimates, shipping charges, and regional restrictions are governed by the current IYILO Shipping & Delivery Policy.
Customers are responsible for providing a complete and accurate shipping address.
Unless otherwise required by applicable law, risk of loss transfers upon confirmed delivery to the shipping address provided with the order.
Carrier delays, weather events, customs delays, and other events outside IYILO’s reasonable control may affect delivery times.
7. Returns and Refunds
Returns, cancellations, and refunds are governed by the current IYILO Return & Refund Policy.
Customers must obtain any required Return Merchandise Authorization (“RMA”) before returning a product.
Installed or hardwired products may be subject to additional return restrictions.
Nothing in this section limits any statutory return or refund rights that cannot legally be excluded.
8. Limited Warranty
Eligible IYILO residential EV chargers are covered by the applicable IYILO Limited Warranty.
The standard warranty period is three (3) years from the original purchase date unless an extended warranty or different written warranty term applies to the specific purchase.
For covered defects in materials or workmanship under normal installation and use, IYILO may:
1. Diagnose and repair the product; or
2. Replace the product if repair is not reasonably feasible.
Any replacement product or component generally carries the remaining warranty period of the original product unless otherwise required by law.
Full warranty terms, exclusions, claim procedures, and remedies are stated in the applicable IYILO Limited Warranty Policy.
9. Installation Requirements and Customer Responsibilities
IYILO EV chargers are electrical equipment and must be installed and used in accordance with:
• The applicable IYILO installation and user manual;
• Product labels and technical specifications;
• Applicable electrical and building codes;
• Required circuit, breaker, wiring, grounding, and current limitations; and
• Applicable local laws and regulations.
Hardwired installations should be performed by a qualified or licensed electrician where required by applicable law.
The customer is responsible for ensuring that the electrical system, circuit, wiring, receptacle, breaker, grounding, and installation environment are suitable for the selected charger and charging current.
Customers must not operate an IYILO charger:
• Above its rated electrical specifications;
• With damaged wiring, connectors, plugs, receptacles, or enclosures;
• After unauthorized modifications;
• In a manner contrary to the installation or user documentation; or
• Where continued use may present an electrical or safety risk.
If abnormal heat, smoke, burning odor, visible damage, repeated electrical faults, or other potentially unsafe conditions occur, stop using the product when it is safe to do so and contact IYILO Support.
10. Misuse, Unauthorized Modification and External Causes
The Limited Warranty may not apply to damage arising from circumstances including:
• Improper installation;
• Incorrect wiring or circuit configuration;
• Operation outside published product specifications;
• Unauthorized modification, disassembly, or repair;
• Use of incompatible third-party components or accessories;
• Electrical surges or unstable power supply;
• External fire, flooding, lightning, impact, pest damage, or other external events; or
• Negligent or abusive use.
The fact that a particular event is excluded from the Limited Warranty does not, by itself, determine whether a separate claim involving alleged product-caused bodily injury or property damage may exist under applicable law.
11. Product Safety Incidents and Claims
A warranty claim for repair or replacement is different from a claim involving alleged bodily injury or property damage.
If a serious incident, including fire, bodily injury, or damage to a home or other property, is alleged to have been caused by an IYILO product, the matter may require a separate investigation.
Customers should promptly contact IYILO and provide available information, including:
• Order information;
• Product serial number;
• Photographs or videos;
• Installation information;
• Electrician or contractor information, if applicable;
• Relevant charger or App logs, where available;
• Details of the incident; and
• Any other reasonably requested documentation.
Where reasonably possible and safe, the affected product and relevant installation components should be preserved for inspection and should not be materially altered or discarded before the investigation is completed.
IYILO may coordinate the investigation with EVRA ENERGY LLC, the product manufacturer, technical experts, insurers, or other qualified third parties.
Any claim will be evaluated based on the circumstances of the incident, available evidence, applicable law, product condition, installation conditions, and other relevant information.
12. Product Liability Insurance
EVRA ENERGY LLC maintains commercial general liability insurance that includes products liability coverage for covered claims.
Any insurance coverage is subject to the applicable insurance policy, including its terms, conditions, exclusions, limits, deductibles, aggregate limits, and claims procedures.
The existence of insurance does not guarantee that any particular claim will be covered or paid and does not entitle any customer to a predetermined amount of compensation.
Where an incident may fall within applicable insurance coverage, EVRA ENERGY LLC may refer or coordinate the matter with its insurer for investigation and claims handling.
13. IYILO App and Connected Services
The IYILO App provides features for compatible IYILO chargers, which may include:
• Bluetooth pairing;
• Charger configuration;
• Remote start and stop;
• Charging-current adjustment;
• Charging schedules;
• Charging-session information;
• Power Sharing;
• Dynamic Load Balancing;
• RFID and user-management functions;
• Firmware updates; and
• Device diagnostics.
Available features may vary depending on charger model, firmware version, network conditions, App version, and geographic region.
Some features require Bluetooth, Wi-Fi, internet connectivity, compatible hardware, or updated firmware.
IYILO may release software or firmware updates that are required for safety, compatibility, functionality, or continued operation.
14. App License and Prohibited Uses
Subject to these Terms, IYILO grants you a limited, revocable, non-exclusive, non-transferable license to use the IYILO App and embedded software solely for their intended purposes.
You may not:
• Reverse engineer, decompile, or disassemble the App or firmware except where legally permitted;
• Circumvent security controls;
• Attempt unauthorized access to IYILO systems;
• Copy, redistribute, or commercially exploit IYILO software without authorization; or
• Use the services for unlawful purposes.
15. Service Availability
IYILO aims to maintain reliable Website, App, cloud, and connected-service availability.
However, we do not guarantee uninterrupted or error-free availability.
Features may temporarily become unavailable because of:
• Internet or network interruptions;
• Third-party service failures;
• Maintenance;
• Firmware or App updates;
• Server interruptions; or
• Events outside IYILO’s reasonable control.
Certain charger functions may continue to operate locally or offline depending on product configuration.
16. Privacy and Data
Use of the IYILO Website and App is also governed by the IYILO Privacy Policy.
Depending on the services used, IYILO may process account information, charger usage information, technical data, diagnostic logs, device information, and other information required to provide and support the services.
For information regarding data collection, use, retention, sharing, and your privacy rights, please review the current IYILO Privacy Policy.
17. Intellectual Property
The IYILO name, trademarks, logos, Website content, App software, product graphics, documentation, firmware, text, photographs, and other intellectual property are owned by or licensed to EVRA ENERGY LLC or its applicable licensors.
No ownership rights are transferred to you through your purchase or use of IYILO products or services.
18. Disclaimer of Website and App Warranties
Except for any express product warranty provided separately, the Website, App, and online services are provided on an “as is” and “as available” basis to the maximum extent permitted by applicable law.
IYILO does not warrant that the Website or App will always be uninterrupted, error-free, or compatible with every third-party device, network, or service.
Nothing in this section limits the express IYILO Limited Warranty applicable to eligible hardware products.
19. Limitation of Liability
To the maximum extent permitted by applicable law, EVRA ENERGY LLC, IYILO, and their affiliates will not be liable for indirect, incidental, special, punitive, or consequential losses arising solely from use of the Website, App, or services, including loss of profits, loss of data, or business interruption.
For claims arising solely from the Website, App, or ordinary contractual performance and not involving liability that cannot legally be limited, IYILO’s aggregate liability will not exceed the amount paid for the affected product or service giving rise to the claim.
Nothing in these Terms excludes or limits liability where such liability cannot lawfully be excluded or limited, including any applicable rights or remedies relating to bodily injury, property damage, fraud, gross negligence, statutory product liability, or mandatory consumer protection law.
20. Third-Party Products and Services
IYILO products and services may interact with third-party networks, payment processors, internet providers, mobile operating systems, smart-home platforms, vehicles, electrical equipment, or other third-party products.
IYILO is not responsible for failures caused solely by third-party products or services outside our reasonable control.
Any third-party service may also be subject to its own terms and policies.
21. Suspension and Termination
IYILO may suspend or terminate access to the Website, App, or certain services where reasonably necessary due to:
• Violation of these Terms;
• Fraud or suspected fraudulent activity;
• Security threats;
• Unauthorized access;
• Misuse of the services; or
• Legal or regulatory requirements.
Termination of App or account access does not automatically affect statutory rights relating to a previously purchased physical product.
22. Governing Law and Disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles, except where mandatory consumer-protection laws in your jurisdiction provide otherwise.
Subject to any rights that cannot legally be waived, disputes relating to these Terms shall be brought before the applicable state or federal courts located in California unless the parties agree to another lawful dispute-resolution process.
Nothing in these Terms limits any mandatory legal rights available to consumers under applicable federal, state, provincial, or local law.
23. Business and Commercial Customers
These Terms primarily govern direct consumer purchases and general use of IYILO products and services.
Distributors, installers, resellers, commercial customers, property managers, fleet operators, and other business customers may be subject to additional or separate written commercial terms.
Where a separately signed commercial agreement conflicts with these Terms, the signed commercial agreement will control with respect to the applicable business transaction.
24. Changes to These Terms
IYILO may update these Terms from time to time to reflect changes in our products, services, policies, laws, or business practices.
The updated Terms will be posted on the IYILO Website with a revised effective date.
Where required by law, material changes will be communicated through the Website, App, email, or another appropriate method.
25. Severability
If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
26. Entire Agreement
These Terms, together with the policies and documents expressly incorporated by reference, constitute the agreement between you and IYILO relating to the applicable purchase and use of IYILO products and services.
